DOJ to ask Supreme Court to block Texas abortion law

(WASHINGTON) — The Department of Justice plans to ask the U.S. Supreme Court to temporarily block the most restrictive abortion law in the country, after a federal appeals court ruled Thursday that the Texas statute can remain in effect amid an ongoing legal challenge.

The law, known as SB8, bans physicians from providing abortions once they detect a so-called fetal heartbeat, which can be seen on an ultrasound as early as six weeks into a pregnancy.

The law, which went into effect on Sept. 1 after the Supreme Court refused to block it, was briefly paused after a federal judge issued a temporary injunction last week barring its enforcement. Days later, the law was reinstated after a panel of judges on the Fifth Circuit Court of Appeals issued a temporary administrative stay.

In the latest ruling in the high-profile case, the court rejected the Justice Department’s request to again halt Texas’ ability to enforce the law. In a 2-1 order Thursday night, a panel of judges granted Texas’s request to continue to stay the preliminary injunction while it pursues its appeal.

The court’s order did not detail its reasoning behind the ruling, which was expected to be appealed to the U.S. Supreme Court.

“Next stop, #SCOTUS,” University of Texas constitutional law professor Steve Vladeck said in a post on Twitter following the ruling.

Indeed, on Friday, DOJ Spokesman Anthony Coley confirmed in a statement to ABC news that the department “intends to ask the Supreme Court to vacate the Fifth Circuit’s stay of the preliminary injunction against Texas Senate Bill 8.”

Under the law, private citizens can sue a person they “reasonably believe” provided an illegal abortion or assisted someone in getting it in the state, and is crafted to prevent any state official, other than judges, from being responsible for enforcement.

In a 113-page ruling initially granting the preliminary injunction, U.S. District Court Judge Robert Pitman was scathing in targeting the state in how he says it schemed to evade judicial review.

“A person’s right under the Constitution to choose to obtain an abortion prior to fetal viability is well established,” Pitman wrote. “Fully aware that depriving its citizens of this right by direct state action would be flagrantly unconstitutional, the State contrived an unprecedented and transparent statutory scheme to do just that.”

After the injunction was issued, some abortion providers in Texas briefly resumed providing abortions after cardiac activity was detected, only to have the ban back in effect within 48 hours.

Since the law went into effect, women have had to travel hundreds of miles to obtain an abortion out-of-state, inundating neighboring states’ abortion clinics. Abortion providers in Texas have that some clinics may have to close permanently because of the law.

Marvel Studios

Disney+ has announced that it will launch its latest Marvel Studios project, Hawkeye, with a double-episode premiere on November 24 — and co-star Hailee Steinfeld can’t wait.

In fact, she still can’t believe she’s now part of the Marvel Cinematic Universe.

“I mean, I still am comprehending the fact that I’m even a part of it,” she tells ABC Audio with a laugh.

“I’m still…trying to form a sentence about it,” says Hailee, who plays Kate Bishop, the protégé of Jeremy Renner‘s Clint Barton/Hawkeye.

As previously reported, the show centers on Barton as he balances family life with the ramifications of his vigilante days, as seen in Avengers: Endgame. Caught in the middle is eager archer Kate.

A new extended teaser presents more of the action and comedy in the series, which is set in New York City during the holidays — and shows more of an already-memed peek of the fictional Rogers: The Musical, about the life of Captain America featuring his heroic pals.

As fans eagerly await the premiere, so is Hailee. “[I]t’s been such a dream,” she says, adding, “You know, to be a part of the MCU is again very hard to comprehend, but a true honor. And I’m so excited for the world to see this show and meet Kate Bishop.”

Until then, the Dickinson star and producer can be seen on November 5, when the third and final season of that acclaimed show gets underway on Apple TV+.

Judas Priest frontman Rob Halford has revealed that he was diagnosed with cancer last year amid the COVID-19 pandemic.

“I had my little cancer battle a year ago, which I got through and that’s in remission now, thank God,” Halford tells Consequence.

“That happened while we were all locked down, so things happen for a reason as far as time sequence of events,” he adds. “I have nothing but gratitude to be at this point in my life, still doing what I love the most.”

As Consequence reports, Halford goes into more detail about his private fight with cancer in the newly released paperback edition of his 2020 book, Confess.

In an added chapter to the book, Halford writes that he underwent surgery to treat prostate cancer in July 2020. When the cancer returned earlier this year, Halford started radiation therapy, and was cleared by doctors in June. His appendix was also removed after it grew a tumor.

“It’s been a draining year, I can’t deny it, but I’m delighted to have come through it,” the book reads.

Meanwhile, Halford’s Priest band mate Richie Faulkner just went through his own scary health ordeal when his aorta ruptured during a performance at September’s Louder than Life festival. He’s currently recovering after undergoing over 10 hours of emergency heart surgery.

One started on a TV talent competition and one started on TikTok. Today, Lauren Jauregui and Dixie, aka Dixie D’Amelio, have new songs for you.

Lauren has announced that her debut solo album, PRELUDE, will be out November 5, and she’s released a new song from the project, “Scattered,” featuring rapper Vic Mensa.  The former Fifth Harmony singer says of the jazzy, dreamy tune, “It’s essentially about my mind being scattered. Vic heard it and felt it. I loved the idea of having a male perspective on assessing mental health.”

Vic adds, “The transparency and the vulnerability, that’s what drew me into the song…I’ve come to realize that when I speak about the myriad of mental issues I go through…not only is it a catharsis for me, it’s also valuable for the world because so many people are going through the same manifestations.”

Dixie, whose current single “Psycho” is climbing the charts, has dropped “The Real Thing,” a song that was featured on her Hulu series The D’Amelio Show, and in promo videos for Social Tourist, the brand she owns with her sister, Charlie.  “The Real Thing” is about the search for true love.

“I’m releasing ‘The Real Thing’ for the fans. The same fans that support me and motivate me to keep going when I’m feeling defeated,” Dixie says in a statement. “You requested this, so I’m delivering the full version to you. I’m so thankful for all of you and I’m really excited to be able to drop this!”

Jordan Davis and Luke Bryan reunite this week for a new version of “Buy Dirt,” a duet that originally came out as the title track of Jordan’s May EP.

This time around, the two stars trade verses on a stripped-down, acoustic version that highlights the song’s message. A new video shows Jordan and Luke performing the song from two bar stools, putting an emphasis on the song’s advice for leading a simple, happy life.

When Jordan first released “Buy Dirt,” he explained that he wanted Luke on the track because the country superstar embodies the message behind the song.

“Luke isn’t just a great entertainer; he’s a great dad, a great husband, and a great friend, too,” Jordan explained. “That’s what ‘Buy Dirt’ embodies. When I wrote ‘Buy Dirt,’ I knew he could relate to the song’s message.”

“Buy Dirt” also lends its name to Jordan’s headlining tour, which kicked off in September. Beginning this month, the singer is also a supporting act on Kane Brown’s Blessed and Free Tour.

As Pharrell Williams considers pulling his Something in the Water Festival from his native Virginia Beach following the fatal police shooting of a family member, fans are planning a peaceful protest to show support for him.

The all-star festival was scheduled for April 22-24, 2022, however the 13-time Grammy winner may move the event to another city because his cousin, Donovon Lynch, was shot and killed by a Virginia Beach police officer on March 26, 2021. Following his death, Pharrell called for a federal investigation.

Xiomara-Rosa Fernandez, who administers a Something in the Water Facebook page, told Norfolk ABC affiliate WVEC-TV that a sit-in will take place on Saturday, November 6 at the Virginia Beach waterfront.

“We sit down at the beach, where the stage was, the main stage,” Fernandez says. She added that she expects fans to attend from other cities.

As previously reported, Pharrell wrote a letter last week in response to city manager Patrick Duhaney, who had written to Pharrell saying he wanted to discuss having the event return.

Pharrell wrote that the goal of the festival was “to ease racial tension, to unify the region, bring about economic development opportunities, and broaden the horizons of the local business community. We achieved those things!”

“I wish the same energy I’ve felt from Virginia Beach leadership upon losing the festival would have been similarly channeled following the loss of my relative’s life,” Williams continued.

The Something in the Water festival debuted in 2019, featuring Travis ScottJanelle MonaeSZA, Migos, Lil Uzi Vert and many more. In 2019, 25,000 tickets to the music festival sold out in 21 minutes, and the total economic impact was over $24 million. The event was canceled in 2020 and 2021 due to the pandemic.
