The lawsuit filed by Nevermind cover baby Spencer Elden against Nirvana has once again been dismissed.

As previously reported, Elden first sued Nirvana in 2021, alleging that the Nevermind cover artwork constitutes child pornography. The now-iconic cover of the 1991 hit album features a photo of Elden at 4 months old, swimming naked in a pool while reaching for a dollar bill on a fishhook.

The suit has been dismissed multiple times, which Elden has responded to by filing amended complaints and appeals. In ruling on the case once more in a filing Tuesday, U.S. District Judge Fernando M. Olguin maintained that it be dismissed with prejudice.

“Neither the pose, focal point, setting, nor overall context suggest the album cover features sexually explicit conduct,” Olguin writes in the ruling, obtained by ABC Audio.

Olguin also points to Elden having “embraced and financially benefitted from being featured on the album cover” for years before filing the suit, including “being paid to reenact the photo, selling autographed album-related posters and memorabilia, participating in interviews about the album cover, and even referring to himself as the ‘Nirvana baby.'”

“Plaintiff’s actions relating to the album over time are difficult to square with his contentions that the album cover constitutes child pornography and that he sustained serious damages as a result of the album cover,” the ruling reads. “In short, the foregoing factors are relevant considerations in the overall context of the photo’s creation, intended purpose, and subsequent use, and further support the court’s finding that the album cover does not constitute child pornography.”

Zac Brown Band continues to expand its upcoming residency at Sphere Las Vegas. 

Initially announced in July, the four original dates are all sold out. The residency launches Dec. 5, the same day the new Love & Fear album arrives. 

ZBB has now added shows on Jan. 16 and 17, 2026, alongside the previously announced Jan. 9 and 10, 2026, performances. 

The Sphere boasts “the world’s highest resolution LED display that wraps up, over, and around the audience creating a fully immersive visual environment,” as well as “the world’s most advanced concert-grade audio system, Sphere Immersive Sound,” all combined with visuals created by each headliner.

Earlier this year, Kenny Chesney became the first country artist to play the innovative venue during his May/June residency. 

Presales for the new ZBB dates start Oct. 6, before tickets become available to the public on Oct. 9.

When Céline Dion staged her big comeback at the 2024 Paris Olympics, her makeup was done by Sofia Tilbury, niece of makeup mogul Charlotte Tilbury. Now Céline is starring in Charlotte’s new holiday campaign.

“Darlings, I’m THRILLED to reveal the LEGENDARY + ICONIC @celinedion as the STAR of my NEW! HOLIDAY CAMPAIGN!” Charlotte wrote on Instagram, alongside the ad that features Celine. “This year is all about STAR CONFIDENCE – and who better to embody it?!”

In the ad, Céline dances beneath a giant disco ball while clutching a bottle of the new Charlotte Tilbury scent, Star Confidence. It’s set to a remix of Celine’s 2022 song “I’m Alive.”

“Céline is the definition of an INTERNATIONAL ICON – her story of perseverance, authenticity + self-belief inspires us all!” Charlotte adds.

Céline says in a statement to WWD, “I’ve always believed music and beauty can uplift and inspire confidence. Having my song ‘I’m Alive’ as the soundtrack felt like a true celebration of resilience and joy.”

Charlotte tells WWD, “When she made her spectacular return to the global stage at the 2024 Paris Olympics – looking radiant and out of this world in a full face of Charlotte Tilbury – I knew exactly who I wanted to bring my holiday 2025 campaign to life.”

She adds that Céline, who lives with stiff-person syndrome, is a “woman of extraordinary strength, humor, and heart whose voice and story have touched millions.”

A Day to Remember has announced a reissue of their 2010 album What Separates Me from You in honor of its 15th anniversary.

The package will be available on vinyl and CD on Nov. 14. The track list includes a bonus acoustic version of the song “All I Want.”

The original What Separates Me from You was A Day to Remember’s highest-charting record at the time, peaking at #11 on the Billboard 200. “All I Want,” the album’s lead single, became the first ADtR song to chart on the Billboard Mainstream Rock Airplay ranking.

A Day to Remember put out their latest album, Big Ole Album Vol. 1, in February. They’ll resume their Maximum Fun tour with Yellowcard Oct. 22 in Ontario, California.

If there’s anyone eager to reconcile Drake and Future, it’s Young Thug. He recently appeared on Adin Ross‘ livestream, where he revealed he’s “been trying” to fix the relationship between his rapper friends.

“Listen, I’m trying. I can show y’all text messages in my phone. I have been trying this s***. I was trying this s*** in jail,” he said. “Like, the s*** in the song [‘Miss My Dogs’ about] trying to get him, Metro [Boomin] and Pluto on the same page? That really happened. Actually happened. That ain’t no cap.”

“That’s real. That really happened. I just try to make it work,” Thugger continued. “Some of y’all’s biggest hits were together.”

Thug’s comments about Future mirror sentiments previously expressed by DJ Khaled, who spoke to Joe & Jada about his neutral stance in the feud and his desire to bring all parties together.                          

“A lot of this s*** is a misunderstanding and a lot of not [communicating]. And that’s what it be about,” Khaled said. “When it comes down to DJ Khaled, I’m gonna be the one that tries to fix it. I love my brothers and my brothers know that. I would love to squash it.”

The tension between Drake and Future reportedly started after Future seemingly took shots at Drizzy on Metro Boomin’s “Like That.” The current status of their friendship is unknown, though journalist Elliott Wilson said they’d quietly resolved their beef.

Elsewhere in Adin’s livestream, Thug confirmed his breakup with Mariah the Scientist following the leaked jail calls where he’d admitted to cheating on her.

“I got broke up with,” he said to Adin. “I still got a girl. She probably don’t got a boyfriend, but I got a girlfriend.”

Morgan Wallen crawls from the wreckage, bloody and bruised, after flipping his truck in the dramatic new video for “I Got Better.” 

As the truck burns and it begins to rain, the superstar walks down a country road, occasionally catching a glimpse of the woman he sings about in his top-five single. 

Having previously called “I Got Better” his “most personal” track on his fourth studio album, the clip serves as a poignant illustration of the song’s message, as you see Morgan’s wounds heal the farther he walks away from the accident. 

In the end, he returns to his truck — which is also mysteriously restored to pristine condition — and lights a cigarette. You can check out the “I Got Better” video on YouTube. 

I’m the Problem has already spent 12 nonconsecutive weeks atop the all-genre Billboard 200 album chart and launched four #1 country singles.

The Doobie BrothersMichael McDonald and the late Jimmy Buffett are set to appear on the upcoming Christmas album from ukulele virtuoso Jake Shimabukuro.

The album, Tis the Season, drops Oct. 17. Buffet’s voice appears on Jake’s version of the classic Hawaiian Christmas song “Mele Kalikimaka.”

“I wouldn’t be where I am today if it weren’t for him,” Jake says of Buffett, who passed away in 2023. “He and (songwriter) Mac McAnally were like my big brothers. They took me under their wings and did so much for me.”

McDonald joins Jake on a cover of the holiday classic “Winter Wonderland,” with both McDonald and Jake playing ukulele on the tune.

“Everyone should know what a great ukulele player Michael is,” Jake says. “His chord knowledge and tone is incredible! And, what’s even more unbelievable is, his ukulele playing sounds like Michael McDonald! So epic!!”

The album also features a cover of John Lennon’s “Happy Xmas (War Is Over)” featuring cellist Yo-Yo Ma, as well as takes on holiday classics like Mariah Carey‘s “All I Want For Christmas Is You,” “This Christmas,” “Jingle Bells,” “O’ Holy Night” and “Rudolph the Red Nosed Reindeer.”

Sabrina Carpenter is a brand ambassador for Redken, and in a new commercial for the beauty brand, she gets to live out her Broadway dreams by dancing her way through a musical number about hair care products.

The clip shows Sabrina in her hotel room trying to reach a tube of her Redken A.B.C. Leave-In Treatment for Hair Repair on top of a mountain of luggage. As she attempts to retrieve it, the luggage falls over and buries her. She’s rescued by a team of singing, dancing bellhops who repeatedly shout, “Leave it in!”

As the bellhops sing that the product will give you “heat protection for the win,” Sabrina quips, “I do love protection!” Cut to Sabina in a feather-trimmed white gown, dancing onstage with the bellhops, who are now wearing top hats and tails. She sits in a chair and holds up a bottle of the conditioner when, out of nowhere, a piece of luggage hits her in the head.

We then see Sabrina lying on the floor of her hotel room. It was all a hallucination caused by the luggage falling on her — or was it? There’s a guy dressed like a giant bottle of the conditioner playing a sax.

Sabrina thinks for a minute and then says, “The longer you leave it in, the better it feels.” And cut.

Maybe Taylor Swift saw the ad before she asked Sabrina to sing with her on the title track of her new album, The Life of a Showgirl?

Sabrina became a brand ambassador for Redken in December 2024.

Jagged Edge is capitalizing on cuffing season with their upcoming trek. They’ve announced the Cuffing Season Tour 2025, a series of shows featuring performances of their party anthems and slow jams, including “I Gotta Be” and “Walked Outta Heaven.” Fans can also expect sets from Lloyd and Eric Bellinger.

Cuffing Season Tour 2025 will kick off this fall, with the first show taking place Nov. 6 at Toyota Arena in Ontario, Canada. The group will then make their way to Oakland, Phoenix, San Antonio, Austin and other cities before wrapping it up Dec. 20 at the Smart Financial Centre at Sugar Land in Houston. 

A presale begins Thursday at 10 a.m. local time, followed by the general sale Friday at 10 a.m. local time.

Make way for two more Broken Branches, as Dierks Bentley expands his 11th studio album. 

“I told y’all I wasn’t done with it! Broken Branches Extended drops this Friday 10/3 everywhere you stream music,” he announced on Instagram. “Who’s ready? #IYKYK”

The hashtag, which stands for “If you know, you know,” also happens to be the title of one of the new tracks. You can hear it playing behind the post’s accompanying video, which shows Dierks putting on a hat with the same initials.

The other new song is “All Night to Figure It Out.” It joins the 11 other songs on the original album, which came out June 13. Broken Branches Extended arrives Friday.
